The PLP are a group of barristers, solicitors, academics and psychologists interested in the operation of the law as it pertains to women during pregnancy and post-birth.

Our primary focus at the time of writing, is the law of infanticide. Under section 1 of the Infanticide Act 1938, a woman is guilty of an offence where by any wilful act or omission she causes the death of her child aged under 12 months. At the time of the act or omission the statute requires the “balance of her mind” to be disturbed by reason of her not having fully recovered from the effect of giving birth to the child or by reason of the effect of lactation consequent upon the birth of the child.

The PLP’s main focus is to collate materials for advocates and experts to help them support women in and out of court . The PLP is also working with partners to provide updated guidance on perinatal disorders and legal issues to ensure informed decision making and to support positive changes in the law.
